TRC Panels Terms of Service

General
The TRC Panels website (https://vet.trcpanels.com) (the “website” or “this website” or “our website”) is owned and operated by Trone Research and Consulting, LLC (“Trone Research”, “TRC”, “us”, “our” or “we”), whose principal place of business is 1835 Eastchester Drive, High Point, NC 27265. The following Terms of Service (“Terms”) govern your use of this website on any platform and in any format (the “Panel”).
Please read these Terms carefully. You may be required to create an account to use certain features of the Panel. We may require your express consent to these Terms and our Privacy Policy before creating an account and using such features. Other features of the Panel may not require your express consent to these Terms and our Privacy Policy. By using the Panel, you acknowledge that you have read and accept these Terms. If you do not agree to be bound by these Terms, do not create an account and do not access or use the Panel.
We have the right, at our sole discretion, to enhance, change or discontinue all or part of the Panel any time. We recommend that you regularly check whether these Terms have been revised. When we make any change to the Terms, we will inform you by changing the date on this page noting when the new Terms were last updated. If we make any material change to these Terms, we will notify you by email or by posting on https://vet.trcpanels.com. Depending on the nature of the change, we may require your express consent to the change. Otherwise, your use of the Panel after any change has been posted will constitute your consent to the new Terms.
We may immediately terminate any individual’s use of the Panel and/or such user’s password(s) or account(s) in the event the user violates these Terms or engages in conduct that Trone Research, in our sole discretion, considers to be unacceptable. Such removal or termination may occur without notice to the user.
Account Registration; Use of Secure Area; Password
In general, you may access and use the Panel for free in keeping with these Terms. However, to access and use certain features of the Panel, you must register and create an account and password. You are responsible for maintaining security and control over your username and password that you create to use these features of the Panel. We are not responsible for any losses arising out of the unauthorized use of your account or the Panel. If you believe that the security of your username and/or password has been compromised, you agree to immediately change your username and/or password to eliminate this security risk. You will notify Trone Research of any known or suspected unauthorized use of, or disclosure related to, your account.
The Panel is intended for veterinarians, veterinary technicians and veterinary practice managers. You agree that TRC may independently verify and/or authenticate your identity in conjunction with your participation in the Panel. The Panel is not intended for those under 21 years old. You must be 21 years old to create an account.
No Children Under 13
The Panel is not directed at or intended for use by children under 13 years old. We do not knowingly collect personal data from children under 13 through the Panel. See our Privacy Policy for more information.
Users Outside the US
The Panel is not directed at or intended for users outside the US. Please be advised that if you are located in the European Union or another region with laws related to data collection and use that may differ from US law, your personal data submitted through the Panel and transferred to the US may not have the same legal data protection as in your jurisdiction. Please review our Privacy Policy for additional information.
Consent to Receive Communications
If you register or sign up to receive surveys, newsletters, updates, emails or any other communications from us, you consent to receive such communications via email or text messaging. We may require your express consent to “opt in” to these communications. You may opt out of these communications at any time using the “unsubscribe” prompts contained at the bottom of the communications.
Sweepstakes
You acknowledge that Trone Research may use sweepstakes to reward individuals who participate in surveys as part of a panel of participants (each such survey, a “Survey”, each such participant, a “Panelist”, and each such panel, a “Participant Panel”). Each Panelist acknowledges that sweepstakes are designed so that not every participant wins, and that many participants will not win any reward for their effort in completing a Survey. Trone Research will include in each email inviting Panelists to participate in any Survey (or otherwise provide with each invitation to Panelists to participate) (a “Survey Invitation”) an approximation of the chances of winning in the sweepstakes and the value of the prize. The actual odds will vary depending on the number of Panelists who participate, and Trone Research may not be able to control the number of Panelists who participate.
No Participation by Persons Under the Age of 21. Only Panelists who are legal residents of the 50 United States, the District of Columbia, U.S. Military personnel (and their families) with APO/FPO addresses who are 21 years of age or older shall be entitled to participate in any sweepstakes reward.
Survey Participation Sweepstakes Rules
Eligibility. Each Panelist who is invited to participate in a particular Survey for a particular Participant Panel (such Survey, a “Qualifying Survey”) and who fully completes such Survey will receive one entry in the sweepstakes for such Participant Panel (each such sweepstakes, the “Participation Sweepstakes”). Employees of TRC and members of their immediate family or persons living in the same household are not eligible.
Prizes: The specific prize(s) for each Participation Sweepstakes will be disclosed as part of the relevant Survey Invitation involving such sweepstakes (“Disclosed Prizes”). Prizes will take the form of Amazon.com eGift cards. Each such eGift card will expire within one year from the date sent to the winner. TRC reserves the right to substitute prizes of equal or greater value for the Disclosed Prize(s). All prizes will be awarded, provided the number of qualifying entries is equal to or greater than the number of prizes. If the number of qualifying entries is less than the number of prizes (but greater than zero) at the time of the sweepstakes drawing, one Disclosed Prize shall be awarded for each qualifying entry. If a potential winner is disqualified for any reason, TRC will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.
How to Enter. Upon full completion of a Qualifying Survey online, the Panelist completing such survey shall automatically have one entry entered into the Participation Sweepstakes.
Timing. The dates the Participation Sweepstakes will be conducted and the drawing date (the “Drawing Date”) will be provided in conjunction with the Survey Invitation. Entries (i.e., completed Qualifying Surveys) must be received by the date specified in the Survey Invitation (the “Deadline”). The sole determinate of time for purposes of entries will be TRC’s server machine located in the Eastern Time zone. In the unusual event that not enough Qualifying Surveys are received by the Deadline, the date of the Deadline may be extended, in TRC’s sole discretion, to allow additional Qualifying Surveys to be submitted. Any such extension shall not exceed 90 days.
Drawing and Odds of Winning. Winner(s) will be randomly selected by TRC from all eligible entries received by the Deadline. Odds of winning depend on the number of entries received. Winner(s) will be notified by email within seven (7) business days of selection. The return of any prize notification or prize as undeliverable may result in disqualification and an alternate winner may be selected. Winner(s) may be subject to federal and/or state tax reporting requirements. In the event we are required to file a Form 1099 with the IRS, you agree to provide us with any necessary information for such filing as a condition to receiving your prize. All income taxes resulting from acceptance of prize are the responsibility of winner. By entering the Participation Sweepstakes, entrant accepts and agrees to these Survey Participation Sweepstakes Rules and the decisions of the TRC, which shall be final in all matters.
Limitation of Liability. By entering the Participation Sweepstakes, entrants waive all right to, and hold TRC harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys' fees) arising out of or in connection with participation in the sweepstakes or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. TRC will not be responsible for: late or incomplete Surveys; an entrant's failure to receive prize notices due to entrant's spam, junk e-mail, or other security settings or for entrants' provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in the sweepstakes; by any human error which may occur in the processing of the entries in the sweepstakes; or any typographical, technological, or other error in the Survey Invitation, administration of the sweepstakes, or announcement of the prize(s). If, in TRC’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the sweepstakes, or if technical difficulties (including viruses and bugs) compromise the integrity of the sweepstakes, TRC reserves the right, in its sole discretion, to cancel or modify the affected sweepstakes in a manner deemed appropriate by TRC. In the event of termination, winners will be selected from among all eligible entries for the relevant sweepstakes received as of the date of termination.
Quarterly Survey Participation Sweepstakes Rules
Eligibility. Each Panelist who is invited to participate in one or more Surveys for one or more Participant Panels (such Survey, a “Qualifying Survey”) and who fully completes such Survey will receive one entry in the Quarterly Survey Participation Sweepstakes (the “Quarterly Sweepstakes”) for each Qualifying Survey completed during a particular calendar quarter. In addition, Panelists who elect to participate in a Survey but are screened out from such Survey (“Out-Screened”) will also receive one entry in the Quarterly Sweepstakes for each Participant Panel from which such Panelist is Out-Screened. Employees of TRC and members of their immediate family or persons living in the same household are not eligible.
Prizes. One (1) Grand Prize: $500 Amazon.com eGift card. Such eGift card will expire within one year from the date sent to the winner. TRC reserves the right to substitute a prize of equal or greater value. If a potential winner is disqualified for any reason, TRC will award the Grand Prize to an alternate winner by random drawing from among all remaining eligible entries.
Publication of Winners. Each winner of the Quarterly Sweepstakes will have the following information published on the website, in our email communications, and in our newsletter: first name, last initial, title, and the city and state in which they practice. You hereby authorize such publication in the even you are a Quarterly Sweepstakes winner.
How to Enter. For each fully completed Qualifying Survey submitted online by a Panelist during a calendar quarter (i.e., January 1 through March 31st, April 1st through June 30th, etc.), and for each Participant Panel for which a Panelist has been Out-Screened, such Panelist shall automatically have one entry entered into the Quarterly Sweepstakes for the relevant calendar quarter. (For example, if during the First Quarter of 2023 a Panelist fully completed and submitted online three Qualifying Surveys and was also Out-Screened with regard to two Participant Panels, the Panelist would have five (5) entries in the Quarterly Sweepstakes for that calendar quarter.)
Timing. For each Quarterly Sweepstakes, the entry period begins on the first day of the relevant calendar quarter and ends at midnight of the same quarter (e.g., January 1 through March 31st). Entries must be received by midnight Eastern Time of the last date of the relevant calendar quarter (the “Quarterly Sweepstakes Deadline”). The sole determinate of time for purposes of entries will be TRC’s server machine located in the Eastern Time zone. The drawing date for each Quarterly Sweepstakes will occur on the 15th calendar day following the end of the calendar quarter. In the event such date falls on a non-business day, the drawing date will occur on next business day.
Drawing and Odds of Winning. The winner will be randomly selected by TRC from all eligible entries received by the Deadline. Odds of winning depend on the number of entries received. The potential winner will be notified either by email within seven (7) business days of selection. The return of any prize notification or prize as undeliverable may result in disqualification and an alternate winner may be selected. Winner(s) may be subject to federal and/or state tax reporting requirements. In the event we are required to file a Form 1099 with the IRS, you agree to provide us with any necessary information for such a filing as a condition to receiving your prize. Referral Rewards
In the event a Panelist refers another potential Survey participant (who has not previously been a Panelist), a $20 Amazon.com eGift card will be awarded to the referring Panelist at the end of the calendar quarter in which the first Survey is successfully completed by the referred participant, provided such first Survey is completed by the referred participant within thirty (30) days of the referral.
Intellectual Property
The Panel and the content appearing on the Panel (the “Panel Content”) are the property of Trone Research or our business partners or licensors and are protected by copyright and other intellectual property laws. You understand and agree that Trone Research (or Trone Research’s business partners or licensors) own all legal right, title and interest in and to the Panel Content appearing on the Panel, including but not limited to intellectual property rights such as copyrights and trademarks. You agree that nothing in this Agreement gives you any right to use any of the intellectual property available on the Panel, including but not limited to the copyrighted content, trademarks, service marks, logos and domain names. Except as explicitly permitted by these Terms or the functionality of the Panel, Panel Content may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, modified, adapted, sideloaded, used in derivative works or otherwise exploited for any other purposes whatsoever without our prior written consent. We may change any Panel Content without notice.
Certain Disclaimers
We may limit the amount of storage space, activity, bandwidth or any other resources available on the Panel in our discretion. Periodically, the Panel may become unavailable due to required maintenance or other reasons. We assume no responsibility for any errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communications line failures, theft, destruction or unauthorized access to, or alteration of, any content or information that you submit on, to or through the Panel.
Code of Conduct – Required and Prohibited Conduct and Uses
REQUIRED: You agree to the following while using the Panel. Any failure to do so violates these Terms and may result in termination of your access to or use of the Panel:
- You will use the Panel only for purposes that are permitted by these Terms and by applicable law and regulations
- You agree that the Panel and the Panel Content may be used only for your personal and non-commercial use
PROHIBITED: You agree not to engage in any of the following while using the Panel. Such conduct violates these Terms and may result in termination of your access to or use of the Panel:
- Using the Panel in any way that violates any applicable federal, state, local or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).
- Accessing or attempting to access the Panel by any means other than through the https://vet.trcpanels.com interface provided by Trone Research or through any automated means.
- Engaging in any activity that interferes with or disrupts the Panel or any network or servers connected to the Panel.
- Engaging in any activity that interferes with or disrupts the Panel or any network or servers connected to the Panel
- Editing or modifying the Panel or Panel Content for any purpose or reproducing, duplicating, coping, selling, trading or reselling the Panel or any portion thereof unless explicitly permitted to do so by these Terms, a separate agreement with Trone Research or applicable law
- Posting or transmitting any falsehoods, misrepresentations or deceptive material; or any content that is unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene, patently offensive, sexually explicit, harassing, hateful or racially or ethnically offensive; or content that would be considered a criminal offense or trespass or give rise to civil liability; or content that is otherwise inappropriate, objectionable or harmful in any way.
- Posting or transmitting any information that poses or creates a safety or security risk to any person.
- Impersonating or attempt to impersonate Trone Research, a Trone Research employee, another user, or any other person or entity.
- Without our prior written approval, posting or transmitting any advertisement, promotion or solicitation of goods or services for commercial purposes (including but not limited to the solicitation of users of the Panel to become users of other online services competitive with Trone Research), or any other form of solicitation involving commercial activities and/or sales, such as contests, sweepstakes, advertising or pyramid schemes.
- Posting or transmitting any information or software that contains a virus, worm, time bomb, Trojan horse, spyware, adware, malware or other harmful, malicious or disruptive component; or tampering with or damaging the Panel in any way whatsoever, including but not limited to by trespass, burdening network capacity, repeatedly posting the same or similar content or uploading or otherwise disseminating viruses, worms, spyware, adware or other malicious code.
- Circumventing, disabling or otherwise interfering with security-related features of the Panel or any features that prevent or restrict use or copying of any content or enforce limitations on use.
- Posting or transmitting material that violates or infringes upon the rights of a third party, including but not limited to copyright, trademark, intellectual property rights, rights of privacy or publicity, real property rights or rights of confidential information.
- Using the Panel for any commercial purpose or unlawful purposes.
Reporting Copyright Infringement and Repeat Infringer Policy
If you are a copyright owner or agent and believe any content or other information appearing on or in the Panel infringes upon your copyrights, you may submit a notification of claimed infringement under the Digital Millennium Copyright Act ("DMCA") containing the following information:
- A physical or electronic signature of a person authorized to act on behalf of the owner of a copyright interest that is allegedly infringed;
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
- Identification of the material that is claimed to be infringing or to be the subject of the infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit us to locate the material;
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number and, if available, an email address;
- A statement that you have a good faith belief that the disputed use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and
- A statement that the information in the notification is accurate, and made under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Trone Research reserves the right to terminate a user’s access to the Panel if we determine, in our sole discretion, that the user is a repeat infringer. For purposes of the DMCA, a repeat infringer is a user who has been notified of infringing activity and has had User Content (as defined above) removed from the Panel more than once.

THIS WEBSITE AND ALL ASPECTS OF THE SERVICE OFFERED ON THIS WEBSITE ARE PROVIDED “AS IS” WITHOUT EXPRESS OR IMPLIED WARRANTY OF ANY KIND (INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT). Termination
If you fail, or if we suspect that you have failed, to comply with any of the provisions of these Terms, we may, in our sole discretion, without notice to you, terminate, suspend, disable or prohibit your access to the Panel. If your access has been terminated, we may, but we are not obligated to unless required by law, irretrievably delete any and all content we have stored pertaining to your activity on the Panel. You may terminate this agreement at any time by simply discontinuing access to and use of the Panel.
Legal Disputes
Choice of Law and Jurisdiction
All matters relating to the Panel and these Terms and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the internal laws of the State of North Carolina without giving effect to any choice or conflict of law provision or rule (whether of the State of North Carolina or any other jurisdiction).
Any legal suit, action or proceeding arising out of, or related to, these Terms or the Panel shall be instituted exclusively in the federal courts of the United States or the courts of the State of North Carolina, in each case located in Guildford County, although we retain the right to bring any suit, action or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Class Action Waiver
WHERE PERMITTED UNDER APPLICABLE LAW, YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST TRONE RESEARCH ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR A CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.
Indemnification
You agree to indemnify, defend and hold harmless Trone Research, our subsidiaries and affiliates and each of their directors, officers, shareholders, members, employees, representatives, successors, agents, partners, clients, service providers and contractors from and against any loss, liability, claim, demand, damage, cost and expense (including reasonable legal fees) asserted by any third party due or arising from or in connection with your use of or conduct on the Panel, your violation of these Terms or your violation of any rights of another user of the Panel. Trone Research reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, which shall not excuse your indemnity obligations.
No Obligation to Participate in Disputes Between Users or Third Parties
If there is a dispute between users of the Panel, or between a user and any third party, you understand and agree that we are under no obligation to become involved. In the event that you have a dispute with one or more other users, you release Trone Research, our subsidiaries and affiliates and each of their officers, employees, shareholders, members, agents, representatives and successors from any and all claims, demands and damages of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and/or the Panel.
Limitation on Time to File Claims
ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE SERVICE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
Miscellaneous
Failure by Trone Research to enforce any provision of these Terms shall not be construed as a waiver of any provision or right. Nothing in these Terms shall be deemed to confer any third-party rights or benefits. These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Trone Research without restriction. If any provision of these Terms, or any portion thereof, is held to be invalid and unenforceable, then the remainder of these Terms nevertheless remain in full force and effect. The Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and Trone Research with respect to the Panel and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Panel.
